State AI Legislation Tracker
Every AI law enacted in the 50 states and DC since 2024. Includes AI bills still pending, and what legislators and witnesses said about them in nine states with hearing transcripts. (Note: In March 2026 the White House asked Congress to preempt state laws that regulate AI development while leaving states their child-safety, consumer-protection and procurement laws, but as of September 2026 Congress has not passed a law doing so.)

One building for each state and DC, sized by the number of AI bills filed since 2024. Each lit window in the building is one enacted AI law. A lit doorway on the east side of the building means hearing transcripts are available for that state.
Where state AI laws stand
As of Oct 5, 2026, 169 AI laws have been enacted across 33 of 51 jurisdictions (the states and DC), and 802 AI bills are still pending. California has the most with 29, then Tennessee with 18. Deepfake laws are the largest type at 43, then rules for specific sectors at 34. Among pending bills, health care leads with 83 and consumer protection follows with 72. By our topic tags, employment has 53 pending bills, only 3 enacted AI laws, and 5 vetoed bills.
Since Sep 27, 2026, 7 bills were added and 4 became law. All 4 laws and all 3 vetoes are California bills. 2 of the laws are health care bills, and the other 2 cover generative AI at public colleges and AI transparency. The 3 vetoed bills include another health care bill and one on mental health professionals. New Jersey filed 3 of the new bills, including civil penalties for generative AI platforms that cause harm and a tax on AI computing to pay for worker transition. 4 Pennsylvania bills changed status, including rules for AI companion apps and for AI use by health insurers.

About this tracker
Most AI policy in the United States is being written in state legislatures and discussed in public hearings and floor debates. Since 2024, 33 states have enacted 169 laws that regulate AI, and 802 more AI bills are pending.
On March 20, 2026, the White House released a National Policy Framework for Artificial Intelligence, a set of legislative recommendations asking Congress to preempt state laws that regulate AI development or hold developers liable for third parties’ unlawful conduct. The framework leaves states their authority over child safety, fraud and consumer protection, their own governments’ use of AI, and zoning. The laws in this tracker include bills that cover any AI related legislation.

Method, in full
- Bills: Pulled from the OpenStates API for the 50 states and DC, limited to bills with legislative action on or after January 1, 2024, including bills first introduced earlier. Search terms: “artificial intelligence”, “deepfake”, “deep fake”, “algorithmic discrimination”, “facial recognition”. Bills that use none of these phrases are not included. OpenStates’ search does not index current DC Council bills, so every DC bill with action since 2024 is pulled and matched against the same terms. For the states, OpenStates searches full bill text; for DC, the match reads only titles and summaries.
- Quotes: Speaker-attributed segments from committee hearings and floor sessions in the 9 states where Gavelin has full transcript coverage (CA, CO, CT, IL, NE, NJ, NY, OH, PA), matched against the same search terms. Segments shorter than 80 characters are excluded to drop procedural remarks.
- Updates: A weekly snapshot, not a live feed. Data as of Oct 5, 2026. An automated job refreshes the data each week and publishes it only when the new data passes its checks.
- Limitations: Speaker attribution is automated, using voice and roster matching, and is about 98% accurate across the Gavelin platform. Check a quote against its source transcript before citing it. The keyword filter admits some marginal bills and misses some narrowly worded ones. Bill data comes only from OpenStates, and some keyword variants are not yet searched, so coverage favors bills that name artificial intelligence outright.
